1. Acceptance of Terms
By accessing or using SafeComments ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users including free-tier users and paying subscribers.
2. Description of Service
SafeComments provides AI-powered comment moderation for YouTube channels. The Service connects to your YouTube account via Google OAuth, reads comments, applies your configured moderation rules, and optionally takes moderation actions (hold, hide, auto-reply) on your behalf.
3. Eligibility
You must be at least 13 years old and capable of forming a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate.
4. Account and Access
You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.
You may revoke SafeComments' access to your YouTube account at any time via Google Account settings. Revoking access will disable moderation features but will not automatically cancel a paid subscription.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Circumvent YouTube's Community Guidelines or Terms of Service
- Harass, abuse, or harm other users or third parties
- Attempt to gain unauthorized access to the Service or its infrastructure
- Reverse-engineer, scrape, or copy any part of the Service not explicitly permitted
- Use automated moderation actions in a way that violates YouTube's API usage policies
6. Subscription and Billing
Some features require a paid subscription. Subscriptions are billed in advance on a monthly or annual cycle. All payments are processed by Stripe. By subscribing you authorize us to charge your payment method on a recurring basis.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; no pro-rated refunds are issued for the remaining period unless required by applicable law.
We reserve the right to change pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.
7. Free Plan Limitations
The free plan includes a limited number of moderated comments per month as described on the Pricing page. We may change free plan limits at any time with reasonable notice.
8. Intellectual Property
All content, software, and technology comprising the Service are owned by SafeComments or its licensors and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.
You retain ownership of your YouTube channel data. By using the Service you grant us a limited license to access and process that data solely to provide the moderation features you configure.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT MODERATION DECISIONS WILL BE ACCURATE.
AI-driven moderation is not perfect. You remain solely responsible for your channel's content and any moderation actions taken. Always review flagged content before taking permanent action.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFECOMMENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold SafeComments harmless from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
12. Termination
We may suspend or terminate your access at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (e.g., disclaimers, limitations of liability) will do so.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which SafeComments is incorporated, without regard to conflict-of-law principles. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.
14. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or in-app notice. Continued use of the Service after the effective date of changes constitutes acceptance.
